To remain compliant, an employer has three primary responsibilities:

1. Obtain authorization and consent from the applicant before requesting the background check.
2. Offer a copy of the report to the applicant if the applicant resides in CA, MN or OK.
3. If taking "adverse action" against an applicant (i.e. not hiring the applicant) due to the findings of the background report, you are required to send the applicant a series of Pre-Adverse and Adverse letters explaining your action including a copy of the report. You can generate these letters from HireRight by selecting the “Letters” option and print & mail, or e-mail the applicant directly.
